Greg Abbott will officially make beer-to-go sales at the state’s manufacturing breweries legal during a June 15 signing ceremony at Austin Beerworks. Abbott’s signature will allow consumers to purchase up to one case of beer (288 fl. oz.) per day from the state’s manufacturing breweries, starting September 1, 2019. Those sales would count against a 5,000-barrel cap that is already in place for on-premise taproom sales at those breweries. His signature will also ensure operations of the state’s alcohol regulatory body, the Texas Alcoholic Beverage Commission (TABC), will continue. Yards Brewing Begins Offering Contract Brewing Services Philadelphia’s Yards Brewing Company is now offering contract brewing services to fill about 60,000 barrels of excess capacity. Yards, which opened a 70,000 sq. ft. production facility and taproom in November 2017, has about 100,000 barrels of annual capacity. Last year, Yards’ production declined 2 percent, to 40,296 barrels, according to data from the Brewers Association. Yards said its first client is New Jersey’s Cape May Brewing Company, according to a press release on the Brewers of PA website. The company is seeking additional partners. US House Committee Expected to Extend Federal Excise Tax Relief for Brewers An effort to maintain reduced federal excise taxes (FET) on all brewers an importers could take a major step forward. The House Ways and Means Committee is expected to extend tax cuts for alcohol producers and importers as part of the Taxpayer Certainty and Disaster Tax Relief Act of 2019 (H.R. 3301) extender bill. Although the committee’s version of tax relief would only extend through the end of 2020, alcohol industry trade groups say they plan to continue efforts to make the tax cuts permanent. The extender would keep in place through December 31, 2020, an excise tax rate of $3.50 per barrel (a reduction from $7 per barrel) on the first 60,000 barrels for domestic brewers producing fewer than 2 million barrels annually. The legislation also sets the federal excise tax to $16 per barrel on the first 6 million barrels for all other brewers and beer importers, while maintaining the $18 per barrel excise tax for brewers producing more than 6 million barrels. The Brewers Association, the Colorado-based trade group supporting over 7,000 small and independent breweries, also supports the bill also plans to continue working alongside the BI to advance the legislation. Cannabiniers on Verge of Next Brewery Acquisition Lighthouse Strategies — the company behind Cannabiniers and the Two Roots line of CBD- and THC-infused non-alcoholic craft beers – is closing in on its next brewery acquisition. CEO and chairman Michael Hayford said the company could finalize the purchase of a craft beer company in the Great Lakes region of the U.S. before the end of June. According to Hayford, who discussed his company’s strategy and outlook on the cannabis space at BevNET’s Cannabis Forum last week in New York City, the forthcoming acquisition will aid Lighthouse’s expansion into the Canadian cannabis market when drinkable products are permitted for sale later this year. Though he declined to name the company, or discuss financial terms of the potential deal, Hayford said the brewing facility is capable of producing between 60,000 and 100,000 barrels of beer annually. In the meantime, Hayford confirmed that Lighthouse has been working with San Diego’s Green Flash Brewing Company for contract beer production. Under the terms of that arrangement, Cannabiniers has access to 50,000 barrels of production capacity annually. About ten years ago, Dan Grim was working in the corporate world when he started reflecting on his legacy. He thought he could make a bigger impact on the world, and amidst his brainstorming, he drove to MJBizCon. He was so excited by what he witnessed in the fledgling cannabis market that he spent the entire ride home writing his new business plan. Grim has been in the cannabis beverage game since 2015. In 2017, he launched Good Stuff Beverage Co., which has received accolades for the company's lemonade mixers. The road to success in the cannabis beverage industry has been challenging, and Grim admits that he had plenty of opportunities to quit. Still, he has persevered, and the beverage industry looks poised for a breakthrough. Grim says cannabis beverage is the fastest-growing segment in the industry, but it's still new. For example, the category recently experienced a large spike, from 0.5% total dispensary spend to 1.1%. Grim looks forward to the day the vertical hits the 5% mark. Part of the problem for upstart beverage brands is a dearth of quality co-packers or contract manufacturers. Today in cannabis news: A congressman urges for the cannabis banking bill to be passed before federal legalization, the New Jersey city cannabis ordinance allows for all six types of cannabis licenses and Rosario Dawson receives a corporate board seat for Cann, a California-based cannabis beverage company. First up: While federal reform is still being considered a Congressman urges the passage of a cannabis banking bill that will protect banks that work with state legal cannabis businesses. Currently the Senate is focused on ending cannabis prohibition, however representative Ed Perlmutter believes that the secure and fair enforcement baking act has a greater chance of passing because it has a narrow focus. In a statement Perlmutter said, “it's important to pass the safe banking act as quickly as possible to address the public safety risk that comes with these businesses being forced to operate cash only.” He also added that "passing the safe banking act is the first step of many federal cannabis reforms to create a safer and more equitable industry. " On the other hand, Cannabis advocates feel that it is a wrong approach to pass a banking bill that does not contain social equity provisions and is favorable in business interest. Last month Senator Cory Booker said, “I will lay myself down "to block any other senators who seek to pass cannabis banking legislation before the body approves a comprehensive cannabis reform. Federal cannabis reform would resolve any banking issues within the cannabis industry however there is not enough support in the Senate to ensure that the reform will be passed anytime soon. Next up: After a second reading, the New Jersey city cannabis ordinance allows for all six types of license classes, lounges and delivery to pass. The six types of cannabis licenses are for manufacturers, cultivators, wholesalers, Distributors, delivery services and dispensaries. In June a measure was passed that allowed consumption lounges but not delivery services at the time. The city Council included provisions that would make it easier for small businesses and social equity applicants to receive licenses. The New Jersey city cannabis ordinance created a three person cannabis control board that overseas and establishes who gets a license. The passage of the ordinance also split cannabis tax funds between the board of education and social equity causes. Councilman Rolando Lavarro proposed an amendment that would not allow for a cannabis dispensary to be within 200 feet of a daycare or substance abuse center. The amendment was challenged by Councilman Jermaine Robinson who felt that 200 feet was too much and that 100 feet would be more manageable but amendment was passed unanimously with a 9-0 vote Last up: Rosario Dawson has officially joined the board of Cann, a California-based cannabis beverage company. She's very impressed with the diversity efforts of the company which creates low THC infused seltzers and is going to further the company's objectives with her involvement. In general less than 3.5% of corporate board seats are held by women of color, giving her a voice to express her “vested interest in federal change and local change.” Dawson's partner, Senator Cory Booker is a co-author of the cannabis administration an opportunity act which with will deschedule cannabis and bring social equity into the industry. However her interest in the cannabis industry did not stem from senator booker but a personal motivation when supporting cannabis legalization. This week, Paulo Sobral, a consultant at Drink Cannabis LLC, discusses why he left Pepsi in 2014 to join an upstart cannabis industry. Sobral is a "cannabis beverage fanatic" focused on helping develop and market innovative products that change the way people consume cannabis. While Sobral was at the Hall of Flowers event in Palm Springs, California, he stepped away from the show to talk about why he left Pepsi's corporate environment and jumped into an industry he found more inspiring. His interest in cannabis beverages started in 2016 when he first tried Cannabis Quencher, which turned out to be his favorite. However, some of the 100 mg drinks available seven years ago were non-homogenous, with sediment at the bottom, oil at the top and they had a tasty roulette-style experience. Coming from Pepsi, he realized the industry needed more consistency to build a sustainable brand. Sobral believes cannabis beverages will be the largest consumer segment in the industry. They are more sessionable, which means more units are consumed. Plus, everybody drinks liquid, he says. Finding the right co-packer can solve this issue, but finding such a co-packer that's willing to make your product is not easy, especially when working with brand partners who are starting from scratch and don't know much about the industry. In this video, Sid Patel, CEO of Beverage Trade Network and Cannabis Drinks Expo, is in conversation with Kenny Morrison, Founder of VCC Brands. Here, Kenny explains what a co-packer partnership looks like in the cannabis market. ***About Kenny Morrison*** [Founder VCC Brands] In 2006 Kenny co-founded a few well-known medical cannabis collectives in Los Angeles and Venice Beach, California now owned by MedMen. In 2008, Kenny founded a pioneering cannabis CPG brand called Venice Cookie Company. The premise centered on the idea that edibles should be tasty, safe, and wellness-oriented. VCC entered the beverage category in 2010 at the request of actor and Venice Beach resident Dennis Hopper, who was searching for a hot cannabis tea while terminally ill with prostate cancer. Other award-winning cannabis beverage brands followed. In 2012 he expanded to the state of Washington as Evergreen Herbal, assisting in the creation of regulations with the Washington State Liquor and Cannabis Board. The company, now known as VCC Brands, house a family of California-bred heritage brands and IP, including California's original bottled canna-beverage, Cannabis Quencher. While serving his second term as a director on the board of California Cannabis Industry Association (CCIA) in 2015, Kenny's Los Angeles-based cannabis business was raided by 100 law enforcement officers and DEA, which led him to co-founding CCMA (California Cannabis Manufacturers Association) in 2016 to advocate on behalf of the state’s most ethical plant-touching operators. As Kenny rebuilt the company from scratch with no money and only his reputation intact, he simultaneously spent three years fighting for the return of his seized cash and property from law enforcement, which was eventually returned in 2018. Kenny is a well-known cannabis CPG pioneer having navigated VCC Brands through well over a decade of profitability and change.
